Terms & Conditions
Last updated: October 16, 2026
These Terms & Conditions ("Terms") govern your use of WAVR, a subcontractor compliance platform (the "Service"), provided by Brian Siembor ("we", "us"). When you use the Service you are contracting with Brian Siembor.
1. Acceptance
By creating an account or continuing to use the Service, you agree to these Terms. If you use the Service for an organization, you confirm you have authority to bind it; if you use it as an individual, you confirm you are of legal age.
2. The Service
WAVR helps construction teams track subcontractor records, store compliance documents such as certificates of insurance and licenses, collect waiver signatures, and use AI tools to review documents and answer questions about records.
3. Accounts
You must provide accurate information, keep it up to date, and keep your login credentials confidential. You are responsible for activity under your account.
4. Acceptable use
You must not misuse the Service, including by:
- using it for any unlawful purpose or in violation of any regulation;
- fraud, spam, or impersonation;
- uploading content that infringes anyone's intellectual property or privacy rights;
- interfering with security, introducing malware, probing, scraping, or reverse engineering the Service;
- reselling or redistributing the Service, or circumventing plan limits.
5. AI features
AI-generated document analysis and answers may be inaccurate or incomplete. You are responsible for the documents and questions you submit, for verifying outputs before relying on them, and for having the rights to the content you upload. AI outputs are not legal, insurance, or professional advice. We may restrict or remove content and refuse or filter outputs that violate these Terms.
6. Intellectual property
We retain all rights in the Service, including its software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You keep ownership of your content and grant us a limited license to host and process it solely to provide the Service.
7. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, renewal, tax, cancellation, and refund terms are governed by Paddle's Buyer Terms. See also our Refund Policy.
8. Service availability
We work to keep the Service reliable, but we do not guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, you may request an export of your data within 30 days, after which it may be deleted.
10. Liability
To the extent permitted by law, our total liability is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential losses such as lost profits or data. Nothing limits liability for fraud, death, or personal injury where the law does not allow it.
11. Changes and contact
We may update these Terms and will post the new version here. These Terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict-of-law principles. Questions: email us at Smartsystemsvending@gmail.com.
